SalinTv holds a strong commitment to respecting copyright and intellectual property rights. As part of this commitment, SalinTv has established the following policy to address copyright infringement in compliance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. 512. The DMCA provides a legal framework for copyright owners to address instances of alleged infringement of their rights on the Internet.

Procedure for Reporting Copyright Infringements: If you genuinely believe that any content available on or accessible through SalinTv’s website or the SalinTv service infringes upon your copyrights, you have the option to submit a notice requesting the removal of the material or the blocking of access to it. To ensure accuracy, please include the following information in your notice (consult legal counsel or refer to 17 U.S.C. 512(c) to verify these requirements):

  1. A physical or electronic signature of an authorized person acting on behalf of the copyright owner, who claims that their copyright has been infringed.
  2. Identification of the copyrighted works claimed to have been infringed on SalinTv’s website or the SalinTv service. In case multiple copyrighted works are involved, you may provide a representative list of such works.
  3. Identification of the material that is alleged to be infringing or the subject of infringing activity, with sufficient information to enable SalinTv to locate the material.
  4. Contact information of the notifier, including address, telephone number, and, if available, an email address.
  5. A statement expressing the notifier’s good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information provided in the notification is accurate, and under penalty of perjury, a declaration that the notifying party is authorized to act on behalf of the copyright owner who is allegedly being infringed.

Counter-Notification

Counter-Notification Upon receiving a notification claiming copyright infringement, SalinTv promptly takes action by removing or blocking access to the reported content. In the event that SalinTv removes or restricts your posted content on the SalinTv website or service, you will receive an email notification informing you of this action. If you genuinely believe that your content does not infringe upon any copyrights, or if you have the necessary authorization from the copyright owner or are permitted by law to post and use the content, you may submit a counter-notice to the Copyright Agent. Please consult legal counsel or refer to 17 U.S.C. 512(g) to confirm the required information:

  1. Your physical or electronic signature.
  2. Identification of the content that was removed or disabled, along with its previous location before removal or disabling.
  3. A statement made under penalty of perjury, expressing your sincere belief that the content was removed or disabled due to a mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, telephone number, and a statement consenting to the jurisdiction of the Federal District Court in the judicial district where your address is located. If your address is outside of the United States, you consent to the jurisdiction of any judicial district in which SalinTv may be found. Additionally, you affirm that you will accept service of process from the person who provided the notification of claimed copyright infringement or their authorized agent.

Once SalinTv receives your counter-notification, it will be forwarded to the party who initially submitted the copyright infringement claim. Please note that forwarded counter-notifications may include personal information of the submitter. By submitting a counter-notification, you acknowledge and consent to the disclosure of your information in this manner. SalinTv will only share the counter-notification with the original claimant and no other parties.

After sending the counter-notification, SalinTv requires the claimant to notify us within 10 business days if they have filed a legal action seeking a court order to restrain you from engaging in infringing activity related to the disputed content. If SalinTv receives such notification, it will not be able to reinstate the content. However, if no such notification is received, SalinTv reserves the right to reinstate the content at its sole discretion within 10 to 14 business days after receiving the counter-notice.

We strongly recommend consulting a legal advisor before submitting a notice or counter-notice. Additionally, please be aware that false claims under the DMCA (17 U.S.C. 512(f)) may result in penalties.

Repeat Infringer Policy:

SalinTv implements a policy that permits the termination of user accounts who are determined to be repeat infringers, under appropriate circumstances. A repeat infringer refers to any user who receives three infringement notices for channels or other content added to the SalinTv service, as described above. By using SalinTv, each user agrees that if their account is terminated as per SalinTv’s Copyright Policy, they will not attempt to create a new account under any name, real or assumed. Furthermore, if a user violates this restriction by opening a new account after being terminated, they agree to indemnify and hold SalinTv harmless for any liability incurred as a result.
